Talk about cannabis cultivation is increasing in Argentina and more people seem to be on the same page, looking to establish it as a legal plant for medical use. Now, Martín García Ongaro, a lawyer and strong defender of cannabis, is proposing the creation of a unique registry that will collect the data of all medical cannabis users and automatically create certificates for those who qualify.
Argentina’s official defender Martín García Ongaro expressed his support for a draft ordinance to create a cannabis users registry. The lawyer, teacher and official defender attended the Administrative and Regulations Commission on Tuesday to support the draft ordinance on the registry of users of medicinal cannabis.
García Ongaro is a professor of Law at the National University of La Pampa, a representative of the Faculty of Economic and Legal Sciences in the chair of medical cannabis, a member of the Asociación Pensamiento Penal (drug policy area), and official defender of the penal jurisdiction.
In front of councilors, he stated that this initiative is a step forward in the process of reinstating the legality of many substances that have been banned for several decades.

As proposed, the registry will be a platform where each user will be able to voluntarily enter and upload their data, which will be protected and restricted. The same platform will generate a certificate, accompanied by a medical report, certifying that that person, due to an illness or disease, is cultivating cannabis at home for medicinal purposes.
The project is currently in debate in the Administrative and Regulations Commission. Different organizations such as Cannapam, as well as biologists Daniel Olivetto and Ayelén Vitale have already expressed their views on the project.
It should be noted that the draft includes the creation of a Medicinal Cannabis Consultative Council, in which users and family members, professionals, universities, NGOs, and members of the legislative and local executive authorities will participate.
The counselor had announced the initiative at the beginning of the year and stressed the urgency of providing a legal framework for cannabis users who grow the plant at home, similar to ordinances passed in San Antonio Oeste and Las Grutas.
The draft ordinance establishes a voluntary regulatory framework within the scope of the Municipality of Santa Rosa for the registration of people who use cannabis for medicinal, therapeutic, medical, and scientific research purposes, guaranteeing and promoting comprehensive healthcare.
The Voluntary Registry of Users and Growers of Medicinal Cannabis and its derivatives is created within the scope of the Municipality of Santa Rosa. It will act as a database for the recording and classification of relevant information.
Users will declare the pathologies they suffer from, with the proper medical certification, along with the specifications that correspond to their cultivation. The database will adequately safeguard the users’ identity, guaranteeing the confidentiality of the sensitive information consigned by people who make up said registry, as required by National Law 25,326 regarding the Protection of Personal Data.
In addition, an interdisciplinary Medicinal Cannabis Advisory Council is created, made up of users and relatives of patients using medicinal cannabis, leading professionals on the subject, members of the legislative and executive powers, universities and members of NGOs. This will provide transparency and guarantee the right of citizens to access adequate healthcare.
Finally, the project establishes that the municipality will promote information dissemination actions that promote awareness about the medicinal use of cannabis oil and its derivatives. These efforts will be aimed at health professionals, scientists, as well as the general public. The goal of this campaign is to inform the public about the cannabis plant and its health benefits, as well as the production of cannabis oil at home for medicinal purposes, among others.
In the notes of the initiative, the authors explained that “the registry created through this ordinance will be implemented through a computer platform to which users will have access, with reservation of identity, supporting the voluntary registration of information about the patient’s clinical and health situation, type of consumption, frequency and dosages, and any other data that is considered important”.
“This platform will also enable users and/or growers of medicinal cannabis to have reliable support for the legitimate purpose of their activity,” the authors said.
