Last Wednesday, the small agricultural production received a visit from a bailiff who served them a summons to appear in the Albi court on May 26th. The dispute is about the request from La Ferme du CBD to remove the mention of “CBD farm” from the website of Le Chanvre du Griffoul.
La Ferme du CBD [Translation: The CBD Farm], a company specializing in distance-selling CBD products, is owned by the Swiss holding company Audacia Group and is likely one of the top 10 e-commerce players for CBD in France.
The Swiss company is demanding €126,000 in damages, plus €5,000 per day if the terms “CBD farm” remain on the website of Le Chanvre du Griffoul, which, as explained in their Facebook post, barely makes €50,000 a year after paying taxes.
Le Chanvre du Griffoul is not the only target of La Ferme du CBD’s legal service. Numerous other brands and competitors have received similar emails, as confirmed by La Ferme du CBD, and have removed the requested mentions, according to Le Chanvre.
Le Chanvre du Griffoul, four former Yellow Vests, believes in the resistance that it considers logical and “just.” They claim that the marketing tactics of La Ferme du CBD mislead customers into believing they are buying CBD-based products directly from a farm. Le Chanvre insists that it’s the CBD producers who are harmed by the actions of La Ferme du CBD.
Le Chanvre du Griffoul has received support from industry colleagues who have also received emails from the legal service of La Ferme du CBD. They are calling for the collection of documents and evidence to build a strong case against the company.
They believe that this trial is an opportunity to shed light on the appropriation methods used by La Ferme du CBD and to demand justice against what they perceive as a liberal monster. They express their determination and confidence in pursuing the case.
When contacted, La Ferme du CBD said, “We believe we are [the victim] of abuses that we have denounced, this after having vainly tried to resolve this problem amicably. We now let justice do its work and will respect the sovereign power of judgment of the seized court. While waiting for the verdict, we can only deplore the strategy of denigration and defamation set up by Le Chanvre du Griffoul aimed at damaging us. We are, of course, in favor of competition, provided it is fair.”
